While Guerin has an admirable track record of public and community service and may very well be the most qualified candidate to run the parks and rec department, the longer she and the city drag out this fight, the more it looks like the city has something to hide.

Cheyenne lawyer Bruce Moats represents Vitale and the Boomerang. He commonly represents the Wyoming Press Association and media organizations including the Casper Star Tribune in seeking public records. Moats told The Associated Press he was surprised by the city of Laramie's decision to use public resources to sue Vitale and the Boomerang in response to their records requests.
This is a classic example of the unintended consequence of electing individuals to office who then become the property of corrupt career bureaucrats (like City Managers) without further oversight from the electorate. Cronyism exists from the highest levels of government (Federal) to, in this case Parks Recreation. The hard and fast rule for this behavior should be guilty by lack of transparency. During the spring and summer, Vitale and the Boomerang continued pressing. The city released some records about Guerin's hiring, but declined to turn over information about her education and work history.
In mid August, the city sued Vitale and the Boomerang, seeking a ruling stating that officials don't need to turn over Guerin's personnel records.
"I've never had it happen before," he said.
As a result of Vitale's and the newspaper's continued pressure, the city changed tactics to "the best defense is a good offense."

Vitale told The Associated Press he requested Guerin's resume and the resumes of all applicants for the job in March, after he said a city resident alerted him to Guerin's hiring.
If she really did meet all of the qualifications that were posted in the job description, shouldn't the city and Guerin rush to turn over the information?
The legal argument is that since the Laramie City Council only directly manages three people, all other city staff are strictly under the purview and control of the city manager.
In posting the position, the city stated the job required a bachelor's degree with major course work in recreation, physical education or similar field. The city also specified five years of responsible recreation management and program administration experience, including two years of supervisory experience.
Laramie's recent filing of a lawsuit against the Boomerang newspaper and a city councilor is the local government equivalent of making halftime adjustments in football.
